Did a photo snafu cause Emmy to snub Calista Flockhart, Ellen Pompeo and Matthew Fox?

Were some shocking omissions from the Emmy top 10 lists due to the lack of a photo next to their names on the official eligibility lists (SEE HERE) that voters used as a reminder of contenders when checking off ballots? One of the most notable snubbees tells Gold Derby, "Yes!" and blames the TV academy.

The lists appeared online and did not include pix of these stars who got snubbed: Calista Flockhart ("Brothers & Sisters"), Matthew Fox ("Lost"), Kelsey Grammer ("Back to You"), Ellen Pompeo ("Grey's Anatomy") and Kate Walsh ("Private Practice"). flockhart, Fox and Pompeo made the Top 10 lists last year. Grammer and Walsh weren't eligible in this category.

Many other stars didn't have their photos posted when voting began, but scrambled to provide them and they were added later. The rep of one snubbed star claims the academy's request for a photo was not included on the entry form, but "buried" in supplemental material. The TV academy denies that. Whatever the case, there were lots of photos missing on the ballot and that might have affected the outcome.

On the first day of voting an academy member called me as he looked over the lists, which had lots and lots of missing pix at that early point. He harrumped in a very catty voice, "I don't see a photo of Matthew Fox! He lost my vote! Hey, what's up with Ellen Pompeo? Too lazy to bother, honey? Well, screw you — I'm voting for Jeanne Tripplehorn!" Clearly, that voter was putting on an exaggerated act for comic effect, but there was obvious truth to his tantrum. When looking over those loooooong lists, your eye obviously goes to ones with photos.

Although that didn't hurt some big-name contenders. None of these stars posted pix, but they made the top 10 runoffs: Patrick Dempsey ("Grey's Anatomy"), James Spader ("Boston Legal"), Mariska Hargitay ("Law & Order: SVU"), Charlie Sheen ("Two and a Half Men"), Holly Hunter ("Saving Grace"), and Eva Longoria ("Desperate Housewives").

A rep for one of the snubbed stars cited above insists, "There was no mention of the requirement of a photo on the two-page entry form, although that form does mention the need for contenders to submit a DVD, episode info, payments, etc. — in other words, most other key details. The photo requirement is buried on page 40 of the 69-page rules book."

When I asked the TV academy for a response, a spokesman said: "In the instructions included with the entry form: 'Performer Awards (Unless otherwise specified below, DVDs and Headshots are due at the time of entry. Please refer to the rules and procedures for specific instructions.' When the producers proofs were sent out for final ballot adjustments, entrants without headshots were noted and requests were made for the photos.

"The Emmy Rules printed book is 146 pages. The performer category begins on page 91 and on page 92 a boxed note in bold immediately follows a brief introductory paragraph under the section heading 'Performer Awards.' On page 40 of the online rules book, which was the first page of the performer rules, again the information regarding the headshot matter is boldface type in a box. It is in a prominent place in both sections.

"We continued accepting and posting headshots on the ballot site after the final deadline for entries (April 21) and the deadline for the return of the producers proof (May 27). There was a two-day period after the ballots were posted during the week of June 2 when the mailbox for the headshot e-mails was filled. Emmy contenders were made aware through a bounced back e-mail that the mailbox was full. We then rectified the problem immediately."

Please, Ellen Pompeo is terrible actress and uncomfortable for most of us to look at. She was miscast. They hoped she would become the next Calista, but she's too limited and not sexy at all. I stopped watching Grey because of her, and I think the show's done with anyhow.

I am amazed at this years top ten. plus if so many fans and critics all agree that the likes of Pompeo was heavily snubbed despite her amazing performance, then something is wrong.

When are we going to get it right?? these awards are now officially a real joke.

Ellen Pompeo deserves a nod, even an award for how she portrayed Meredith Grey and carried the whole show in season 4. She was simply perfect.

Snubbing her from the top 10 is a clear sign of the week messed up system the Emmys depend on to pick their nominees.

With it going on like this, they are loosing their stature as a good award show. It doesn't measure to much anymore, since it seems any lousy actor and actress can get it for reasons no one knows. This is very pathetic really.

Ellen Pompeo was definitely snubbed. Her acting in season 4 of Grey's Anatomy was astounding. Voters should really think about the work that the actors did, not if they submitted a photo or not. The Emmys should really think through all of the details of voting and how they effect things.

Ellen Pomeo did not make the Top 10 because she is a mediocre actress & thw weakest performer on Greys. No surprise there.

To blame it on a lack of photo submission is pathetic. Reminding people of her botox-enhanced flat face isn't going to swing the vite her way.

Oh fer chrissakes, people... read the damn article. It actually refutes the supposed conspiracy by listing all the actors who made it despite ALSO NOT having photos, some even from the same shows as the "snubbed." This is pointless and fabricated.

Snubbing Ellen Pompeo and Mathew Fox only showed us how biased and cheaters all those Emmy people are.

This award show is a shame and disgrace to the hollywood community and Americans.

I hope thats not the case. it would be really pathetic and will only turn the Emmys into a bigger joke than they already are.

But if the world seems to agree that Ellen Pompeo was snubbed big time, shouldn't the Emmys do something about that???

if a show is lame and stupid then an emmy is on the way.

Oh come on! Someone's looking for excuses. Michael Emerson had no photo submitted and yet he was nominated. If the voters don't know these names then the problem is with the actor and not the voter. Get over it. They were not nominated because the voters didn't nominate them. The.End.

Oh please...like we don't know what these people (esp. the overrated Calista Pfeiffer Jr.) look like...what I want to know is WHY Dana Delany is not in the final ten but Conchata Ferrell is! ;(

The Emmy Awards are ridiculous. They give out far too many acting awards to begin with. I'd say there are more people who have WON Emmys than those who have lost. Unfortunately, some of the most talented people from TV
never won, like Angela Lansburgy and Jackie Gleason, while some real no talents have won 3 or 4 times in the same category. Why not just draw lottery numbers to see who "wins".
I don't know, but maybe Matthew Fox should be honored that he won't be nominated.

This award is a shame, this procedure could be called illegal!!!
I agree in Europe, they reward the talent not the popularity.

I feel really sad for Ellen Pompeo , she was fab this last season, she really supported her show on her back, if it wasn't for her I wouldn't even watch GA!

if we can't even separate between actual excellence in performance and talent and pictures and looking good and popularity, then this industry has totally lost it. no hope left.

Ellen Pompeo should be nominated. they should fix this. redeem themselves a little.

If the pictures not being there was the reason Ellen P. was snubbed, then someone needs to shut the Emmys down and redo and rethink this whole award show process in hollywood.

The world is laughing at us because we can't award the right people for talent and excellence in preformance, rather we are awarding them for looks and popularity among crazy teens.

All the awards in Italy Cannes and France are now much more respectable and looked at as a true award, than any award show here in Hollywood.

Wow...if Matthew Foxx and Ellen Pompeo were snubbed because this then I wouldn't them or any other great actor nominated for an emmy...How pathetic and childish...

If they did snub Ellen Pompeo after her amazing phneomenal preformance in season 4 as Meredith Grey because her photo was missing, then those people need serious help and lost any inch of respect anyone can have for them.

It's a joke. that's not how you run an award show like the Emmys.. whats going on in this world, we are turning more and more into meaningless, superficial industry were talent no longer matters. You don't need to know how to act, just provide a good pic..... IT'S A JOKE.
